THANE: Congress leader Rahul Gandhi’s application, seeking transfer of a suit filed against him by Rashtriya Swayamsevak Sangh (RSS) volunteers, was turned down by the principal district judge of Thane.
The matter pertains to Rahul allegedly linking the RSS with Gauri Lankesh’s murder. An RSS volunteer, Vivek Champanerkar, has filed a civil defamation suit contending that they are a social organisation and being defamed by comments made by Rahul and the general secretary of the Communist Party of India (Marxist), Sitaram Yechury.
Rahul is seeking transfer of the suit filed by RSS activist Champanerkar on the grounds that it is being tried by a Civil Judge Senior Division but it ought to be tried by Civil Judge Junior Division as claim is only of Rs 1.
Counsel for RSS volunteer, Aditya Mishra, said that the order was passed last year on December 6 but it was uploaded only on Tuesday.
“I filed my reply to his transfer application and resisted it. It was nothing but a frivolous application preferred by Rahul Gandhi to linger the matter,” Mishra said.
In the order , the judge said “…I do not find any substance in the contention of the applicant to transfer the matter from the Civil Judge of Senior Division (CJSD) court to the Civil Judge of Junior Division (CJJD) court on the ground(s) of pecuniary jurisdiction.”
